Official Rules of Nebraska State Bank & Trust Co. Seasons of Custer County Photo Contest:

1)      All photos must be taken in Custer County, Nebraska**. The photographer/entrant does not need to reside in Custer County, Nebraska, but the photo must be of Custer County, Nebraska subject matter. Photographers of all ages are welcome and do not need to be a customer of Nebraska State Bank & Trust Co. to enter. **Exceptions may be made for pictures submitted by NSB customers that reside outside of Custer County.

2)      Number of Submissions: Each entrant may submit up to 15 images; however, entrants must complete a separate submission form for each photograph entered.

3)      Photograph Format: Photographs must be submitted in digital format, in color and must be available in high resolution format (300+ dpi or 2880x3600px minimum) upon request. A lesser resolution may be submitted, but the aforementioned high resolution format must be available if selected. Camera phones generally do not meet the high resolution standards as referenced above.  Entrants must submit the actual image file, not a link or other type of file.  If an image file is not readable, the entry will be disqualified.  

4)      Photograph Ownership: By entering, entrant warrants that the photograph submitted is original and is entrant’s own, and does not infringe on the rights of any third party.  Entrant further warrants that entrant’s participation in this photo contest does not violate any agreement between entrant and any third party.

5)   Rights to Use Photographs: By entering the contest, all entrants grant Nebraska State Bank & Trust Co. (hereinafter “NSB”), and those authorized by NSB, an irrevocable, royalty-free, perpetual, non-exclusive license to publicly display, distribute, reproduce and create derivative works of the entries, in whole or in part, in any media now existing or later developed, for any NSB purpose, including, but not limited to, exhibition within any of NSB’s branches. Any photograph reproduced will include a photographer credit, if photographer allows. Subject to the rights granted to NSB, entrant retains all other copyrights and rights to future use of the photographs entered into the contest.

6)   Permission to Use Photographs That Include Recognizable People: If entrant’s photograph(s) include a recognizable person or people (i.e., person’s or people’s features are easily recognizable to the viewer), entrant must secure written permission from each person (or in the case of a minor, the minor's parent or guardian) to use his/her image in the photo contest and for subsequent use of the photograph by NSB - all prior to submission of the photograph(s) to the photo contest. This written permission or release should be available to be presented immediately to NSB, if requested.  NSB reserves the right to disqualify an entry if it finds, in its sole discretion, that an entrant has not secured a necessary release. 

7)   Limitation of liability: By entering this contest, all entrants agree to release, discharge, and hold harmless NSB and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this contest or any contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

8)   Conditions: THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this contest shall be subject to and governed by the laws of the State of Nebraska and the forum for any dispute shall be in the State of Nebraska, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries are void if NSB determines the photograph to not be an original, or if the entries are incomplete, inaccessible or blocked, corrupted, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these Official Rules; and (b) that the decisions of the committee are final and binding with respect to all matters relating to the contest.

NSB reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant's identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by NSB to enforce any of its rights at any stage does not constitute a waiver of those rights.

Judging Criteria:

After the close of the entry period (10/31/2022), eligible photographs will be judged based on certain criteria, as follows: image content, representation of Custer County, and best fit for display within NSB. Preliminary judging will be done by a committee of NSB employees. The decisions of this committee are final and binding.

Photo Selection:

On or before December 31, 2022, NSB shall notify each prize winner of his or her selection.  Notification shall be by email and/or by telephone.  A minimum of 20 winning photos will be chosen. Winning photos will be enlarged, printed, and displayed in Nebraska State Bank & Trust Co.’s bank branches. Entrants will receive $100 for each photograph chosen for display and meeting all eligibility qualifications.

Legal Terms & Conditions:

This photo contest is subject to all applicable federal, state and local laws and regulations. As an entrant in this photo contest, it is entrant’s responsibility to determine that if entrant is eligible to enter and to comply with the entry instructions and other photo contest rules set forth herein.  Any violation of the contest rules may result in entrant’s disqualification.
